1) Appeal made
Special Counsel Jack Smith is not giving up on his classified documents case against former President Donald Trump.
The news: Smith appealed a federal judge's dismissal of the case to the 11th Circuit Court of Appeals yesterday. U.S. District Judge Aileen Cannon tossed the case last month after ruling Smith had no right to prosecute it. The judge said he did not receive U.S. Senate confirmation at any point in his career and was also unlawfully appointed by Attorney General Merrick Garland.
The counter: Smith argued that Cannon -- a Trump appointee accused of decisions that benefit the former president -- made a "nonsensical" ruling. Smith argued she broke with decades of longstanding practice and legal precedent regarding the AG's authority to appoint special prosecutors.
Big picture: Most legal scholars expect Smith's appeal will be successful; Cannon has already been overturned by the appeals court twice for rulings in the case. Smith has not asked for Cannon to be removed from the case. Any trial is unlikely to happen before Election Day.
2) Robo cops
Artificial intelligence is being applied to a law enforcement bedrock.
The news: A handful of police departments have begun using AI to write the first draft of incident reports, according to The Associated Press. The technology is similar to ChatGPT and is sold by Axon, a technology company that invented the Taser and is the biggest supplier of police body cameras.
The benefits: Cops who have tried the technology say it saves them hours of desk work and produces accurate copy. One Oklahoma City officer said the AI chatbot produced an initial report that included data he had forgotten during a lengthy search for crime suspects. The chatbot operates off a microphone attached to a body camera that picks up speech, radio chatter and more.
The concerns: Police reports are critical to the criminal justice system. Legal scholars and watchdog groups have raised questions about whether the reports will be accurate and if AI could behave in a discriminatory manner. There is also the issue of cops reviewing the AI product and ensuring its accuracy, a concern raised by prosecutors.
3) Unfriendly skies
Japan accused China's military of violating its airspace for the first time.
What happened: Japan alleges a Chinese intelligence plane flew over waters near the Danjo Islands. Japan then scrambled fighter jets. The Chinese jet was in Japan's airspace for about two minutes and spent about two hours in the general vicinity.
The reaction: Japan lodged "an extremely serious protest" with China and asked for a pledge it would not happen again. But some Japanese officials cautioned the incident was likely unintentional and not an intentional provocation in the East China Sea.
Big picture: U.S. National Security Adviser Jake Sullivan is in Beijing today to meet with Chinese officials. That summit is expected to focus on Taiwan. But China continues to be aggressive in its South China Sea dispute with the Phillippines; China and Japan also contest the Senkaku Islands in the East China Sea.
