1) Trump tripped up

A federal appeals court said former President Donald Trump is not immune from prosecution in his election interference trial.

  • The decision: The U.S. Court of Appeals for the D.C. Circuit soundly rejected Trump's claims of complete presidential immunity. A three-judge panel said any executive immunity Trump may have had in office does not apply to a post-presidency criminal case.

  • Next steps: Trump has until Monday to appeal to the Supreme Court. The high court has already declined to hear the matter once; legal analysts believe it may pass again if Trump appeals.

  • Big picture: Trump has delayed the trial with his legal maneuvering, but the strength of the ruling increases the odds it will happen well before Election Day in November. The verdict could impact Trump's anticipated candidacy as the Republican presidential nominee.

2) Bacteria breakthrough

A decade-long listeria outbreak was traced to a California cheese and dairy company.

  • Action taken: Dozens of dairy products produced by Rizo-Lopez Foods in Modesto were recalled. Whole Foods sells one of the products under its 365 store brand.

  • Lengthy issue: The particular strain of listeria was first observed in 2014. At least 26 people in 11 states have reported illness in the last 10 years, with 23 hospitalizations and two deaths. This is the first time the CDC has identified a source, but it has been tied to other manufacturers.

  • Need to know: Listeria is a foodborne bacteria that can cause serious illness and death in rare cases. Symptoms such as fever and muscle aches typically present within two weeks of exposure.

3) Storm talk

There is a renewed push to create a Category 6 to assess hurricane strength.

  • The news: A study published in Proceedings of the National Academy of Sciences advocates to revise the Saffir-Simpson Hurricane Wind scale. It argues there is no upper threshold for Category 5 storms and stronger hurricanes are becoming the norm due to climate change.

  • The numbers: One of the lead researchers said five storms met the proposed Category 6 criteria in the last decade. The most powerful, Hurricane Patricia in 2015, had 215 MPH winds -- well over the 156 MPH Category 5 minimum.

  • Big picture: The National Hurricane Center would decide any change to the grading scale. It has yet to comment on the proposal, but it is likely not a top priority.
