The Top Tip
Back and forth
A Maryland man who was wrongly deported to El Salvador is no longer in federal custody, but may be removed from the country again.
The news: Kilmar Abrego Garcia was released in Tennessee on Friday and returned to his home state. But his attorneys allege the Justice Department is threatening to deport him to Uganda if he does not accept a plea deal.
The backstory: Abrego Garcia was illegally deported to his native El Salvador in March despite a judge's order prohibiting it. The Trump Administration has repeatedly claimed he is a member of the MS-13 gang without any evidence and defied several court orders to return him from an infamous Salvadoran prison before eventually relenting. He was then charged with human smuggling in Tennessee.
Go deeper: Abrego Garcia has denied being tied to MS-13 and maintains he is innocent of the federal charges. His legal team said the Justice Department tried to "coerce" a guilty plea by offering him deportation to and legal status in Costa Rica if he pleaded guilty and served jail time. The alternative was a threatened deportation to Uganda; the African nation recently agreed to accept deportees from the U.S.
Big picture: Abrego Garcia was ordered to appear at ICE's Baltimore office today. His attorneys expect he will be detained again. They plan to fight any deportation order. Uganda's deal with the Trump Administration says it will not accept deportees with criminal records, which could complicate the administration’s ploy.
